IN SIMULTANEOUS USAGE OF THESE PRODUCTS, PER PURCHASE.
Please READ THIS License Agreement before using / opening this font / font package / font set. When you select this font / package / set, you accept all of the terms and conditions of this License Agreement. It is expressly prohibited by Treacyfaces to duplicate any or all of any of Treacyfaces or Headliners font data, or glyphs printed from that Treacyfaces or Headliners font data, including the glyph depictions contained in our WWW.TREACYFACES.COM and FONT CATALOG specimen pages intended solely as an aid to ordering our fonts from our WWW.TREACYFACES.COM and FONT CATALOG, for any purpose outside the terms contained herein, whether for resale or not. The elements comprising the Treacyfaces or Headliners-created data, proprietary trade dress, brand name trademarks, glyphs and related proprietary information are variously protected by trademark, copyright and trade secrets laws, updated continually. Unlicensed remanufacturing and / or redistribution of any Treacyfaces or Headliners font software will likely invite prosecution under all applicable federal, state and local laws, with the potential for severe and substantial monetary penalties and other penalties. Note: Treacyfaces or Headliners screen fonts are never to be freely distributed without the prior express written permission of Treacyfaces, Inc.
However, please know that we respect our registered Treacyfaces or Headliners font users greatly, and we pledge to continue to bring them the very finest in uniquely new and original fonts. The quality in design and care in spacing will keep your licensed Treacyfaces or Headliners fonts working well for you for years to come. We sincerely appreciate your business, and your continuing support.
For further information on licensing Treacyfaces or Headliners fonts, customized Treacyfaces fonts, or completely custom fonts, for situations other than the typical end-user applications inferred herein, please write a detailed letter stating your intentions to Treacyfaces, Inc. / Font Licensing Manager, P.O. Box 26036, West Haven, CT 06516-8036 USA. For further information on multi-user, multi-cpu licensing or multi-printer licensing of Treacyfaces fonts to accommodate your special situation, please write a detailed letter stating your intentions to Treacyfaces, Inc. / Font Licensing Manager, P.O. Box 26036, West Haven, CT 06516-8036 USA. We will respond with an economical licensing schedule that we think will both best suit your needs, and provide you appropriate access.
1. "Encoded Treacyfaces Font Programs" means the digitally encoded machine-readable outline font programs, metric information including kerning pair tables, and bit map screen font data, as encoded in a special format identified on the disk label(s) and related documentation provided by Treacyfaces.
2. This is a non-exclusive sublicense permitting you to use the software contained herein, which you have selected. The license herein granted is not to be deemed a sale of the original program or any subsequent version thereof, the ownership and title to which remains the exclusive property of Treacyfaces, Inc. You agree that this is commercial software, created and offered under license to you solely under the terms contained herein, in exchange for a monetary transaction to be solely calculated by Treacyfaces, Inc.
3. NOTICE: CPU-BASED FONT LICENSE TERMS: You agree to use the Encoded Treacyfaces Font Programs to reproduce and display the styles, versions and weights, of the letters, numerals, characters and symbols ("Typefaces") as contained in the software encoding and to make the Treacyfaces or Headliners Encoded Font Program(s) resident on NO MORE THAN FIVE (5) ON-SITE CPUs (COMPUTERS) AT A TIME, AND NO MORE THAN TWO (2) ON-SITE PRINTER DEVICES AT A TIME, solely for your own customary business or personal purposes, and in any event, never for duplication and / or redistribution as commercial or noncommercial font or nonfont products. Under the terms of this agreement, you are restricted to the use of the data content of this software package to running on no more than five cpus and / or no more than two printer devices at a time. If you need to use the software on more than five cpus and / or more than two printer devices at a time, you must then first send an additional license fee (called a multi-cpu license fee, or a multi-printer license fee, as will prove applicable to your needs) to Treacyfaces for each software package required for your needs. You are responsible to ensure that copies of this software are not transferred or stored on any other computer for longer than the total time it will take you to complete the specific creative work for which you are there to use the software. You may never show a full font display (or a complete font matrix) over 5mm in font height (determined by the "body" or "slug" size) without a grey screen represented by (at its finest) a 133-line dot (or equivalent), without prior express written permission of Treacyfaces.
In addition, you will only receive product enhancements, updates and announcements if the TREACYFACES PRODUCT REGISTRATION CARD INCLUDED IN THE "READ ME" FILE AUTOMATICALLY DOWNLOADED TO YOU ALONG WITH YOUR WWW.TREACYFACES.COM OR FONT CATALOG TREACYFACES OR HEADLINERS FONT PURCHASE is returned to Treacyfaces, Inc., using the mailing instructions shown on the Registration Card. Please note: You should register immediately by fax or by e-mail (to the e-address in the Catalog) to receive the full benefit of technical support available to you under the terms of your license purchase.
4. The data structure, data sequence and data organization of the Encoded Treacyfaces Font Program, and selected compilations of characters and symbols which comprise each font are the valuable property of Treacyfaces, Inc. as well as in many cases, the valuable property(ies) of any artists and / or their estates that Treacyfaces may have fully licensed the font(s) from. RESTRICTIONS ON COPYING THE SOFTWARE FOR BACK-UPS: You are prohibited from making a copy of the Treacyfaces software you purchase and subsequently download from WWW.TREACYFACES.COM e-mail return or auto-download, except for a maximum of two (2) copies to be used strictly as archival or back-up purposes only. All back-up or archival copies you make and store, shall plainly bear the copyright notice of Treacyfaces.
5. You agree not to modify, adapt, translate, reverse engineer, decompile or disassemble, trace or create derivative works based on the encoded Treacyfaces / Headliners Font Programs. The sole exception to this stipulation is where the font data must be converted to paths within an end-user page layout or drawing program, for a purpose other than to create a commercial or noncommercial font or primarily-font-using product based on the Treacyfaces / Headliners data. In that single instance of allowable data and / or glyph translation, all terms of this license shall remain in full force.
6. Trademarks shall be used in accordance with accepted trademark practice including the identification of trademark owner’s name. Our trademarks can only be used to identify printed (or video-displayed) output produced by the Encoded Treacyfaces or Headliners Font Programs. Except as stated above, this Agreement does not grant you any intellectual property rights in or to the Encoded Treacyfaces or Headliners Font Programs, or any rights of ownership in that trademark. You are prohibited from using any of the techniques, algorithms, processes, trade secrets, or proprietary information contained in the software, either in disk data form, or as printouts made directly or indirectly from or sourcing the Treacyfaces or Headliners data.
7. You shall take all reasonable steps to protect the software from theft or use in a manner inconsistent with this License Agreement. All original disks and documentation, back-up disks or archival disks shall be stored in a locked, safe environment on-site at your place of business, and as the recipient of this license, you shall be responsible for discouraging and / or preventing any use of the Treacyfaces software that is outside the scope of this license. You are prohibited from renting, leasing, networking or distributing the software, any of its related documentation and/or trademarks.
8. Your rights under this Agreement may only be assigned to a third party who agrees in writing to be bound by this Agreement prior to the assignment provided that you transfer all copies of the Encoded Treacyfaces or Headliners Font Programs and related documentation to the third party and simultaneously destroy any copies not transferred. Any such transfer of rights must be documented in a notarized letter to Treacyfaces, Inc. Except as set forth in this paragraph, you may not otherwise assign your rights under this Agreement.
9. THIS IS A 50-YEAR LIMITED LICENSE. For example, for a Treacyfaces or Headliners font licensing transaction completed in 1997, this license is effective until 12:00:00pm midnight on the anniversary of of your purchase date in the year 2047. However, Treacyfaces maintains the right to terminate your license immediately if you fail to comply with any term or condition of this Agreement. Upon any such termination, you will destroy the Encoded Treacyfaces or Headliners Font Programs and related documentation obtained by you / your company, as well as all copies or modifications in any form, and cease all use of the trademarks. The provision of this Agreement relating to the proprietary rights of Treacyfaces or Headliners shall survive any such termination. At 12:00:00pm midnight on the anniversary of of your purchase date in the year 2047, or the end of your license, you agree to return all applicable original and backup or archival software, packaging and documentation to Treacyfaces / Headliners, or send a notarized letter attesting in detail to its destruction.
10. 90-DAY SOFTWARE LIMITED WARRANTY. Treacyfaces, Inc. warrants that for ninety (90) days after delivery, the Encoded Treacyfaces Font Programs will perform in accordance with Treacyfaces-published specifications, under normal use and service. Treacyfaces, Inc. does not warrant the Encoded Treacyfaces or Headliners Font Programs to be free from all bugs, errors and omissions. For the purpose of this Agreement, a “bug”, “error” and / or “omission” shall be a flaw(s) in the Encoded Treacyfaces or Headliners Font Programs which causes it not to reproduce the Treacyfaces or Headliners version of the font(s) that are the subject of this license. The 90-Day term of this limited warranty begins when the TREACYFACES OR HEADLINERS PRODUCT REGISTRATION CARD INCLUDED IN THE "READ ME" FILE AUTOMATICALLY DOWNLOADED TO YOU ALONG WITH YOUR WWW.TREACYFACES.COM OR FONT CATALOG TREACYFACES FONT PURCHASE is returned to Treacyfaces, Inc.
11. The entire liability of Treacyfaces and your exclusive remedy under this Agreement in connection with the Encoded Treacyfaces or Headliners Font Programs and Typefaces shall be, at the option and cost of Treacyfaces, to replace the data and / or data disk(s) supplied with your order, that prove to not meet the Treacyfaces Limited Warranty, or to obtain a refund of the license fee for the Encoded Treacyfaces or Headliners Font Programs. You must report all defects and return the Encoded Treacyfaces or Headliners Font Program at your expense to the location where you obtained it, within the Limited Warranty period, to be eligible for Treacyfaces / Headliners Font Warranty Service. If failure of the Treacyfaces product resulted from misapplication of the product, abuse or accident then Treacyfaces shall have no responsibility to replace the data [or data disk(s)] under this Limited Warranty. TREACYFACES CANNOT AND DOES NOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE ENCODED TREACYFACES OR HEADLINERS FONT PROGRAMS AND / OR DOCUMENTATION.
12. EXCEPT FOR THE FOREGOING, THE PARTIES AGREE THAT ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY, ARE EXCLUDED. IN NO EVENT WILL TREACYFACES OR HEADLINERS BE LIABLE TO YOU / YOUR COMPANY FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, OR FOR ANY CLAIM BY ANY PARTY.
13. Some states, provinces or countries do not allow the exclusion of implied warranties or limitations on how long an implied warranty may last, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state, province to province, country to country. For further warranty information, you may contact the Treacyfaces / Headliners Font Service Department by mail at Treacyfaces, Inc., P.O. Box 26036, West Haven, Connecticut (CT) 06516-8036 USA, including a self-addressed, stamped envelope (unless your locale’s laws prohibit us from requiring it).
14. This Agreement will be governed by the laws of the State of Connecticut in the United States of America.
15. If any portion or provision of this Agreement shall be held invalid, inoperative or unenforceable, the remaining provisions of this Agreement shall remain valid and enforceable and shall be construed so as to give the fullest possible effect to the intentions of the parties as set forth herein.
16. Use, duplication or disclosure by the Government of this software is licensed only with “Restricted Rights” as that term is defined in the DoD Supplement to the Federal Acquisition Regulations and the Rights in Technical Data and Computer Software clause at FAR 252.227-7013(b)(3)(ii) and its successors, as appropriate. Further use, duplication or disclosure is subject to applicable restrictions as otherwise set forth in FAR 52.227.19(c)(2).
17. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, THAT YOU UNDERSTAND IT AND THAT IT IS THE COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN TREACYFACES AND YOU, WHICH SUPERCEDES ANY PRIOR ORAL OR WRITTEN AGREEMENT, AND ANY OTHER COMMUNICATIONS BETWEEN TREACYFACES AND YOU / YOUR COMPANY RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT, AND THAT YOUR OBLIGATIONS UNDER THIS AGREEMENT SHALL INURE TO THE BENEFIT OF THE TREACYFACES OR HEADLINERS LICENSORS WHOSE RIGHTS ARE LICENSED UNDER THIS AGREEMENT. NO VARIATION OF THE TERMS OF THIS AGREEMENT OR ANY DIFFERENT TERMS WILL BE ENFORCEABLE AGAINST TREACYFACES OR HEADLINERS UNLESS TREACYFACES GIVES ITS EXPRESS CONSENT, INCLUDING AN EXPRESS WAIVER OF THE TERMS OF THIS AGREEMENT, IN WRITING, SIGNED BY TREACYFACES.

What information does Treacyfaces collect?
In the course of its business activities and providing the services, Treacyfaces will sometimes need to process personal data.
